Bombay High Court

SANGITA RAMESH PATILversusTHE STATE OF MAHARASHTRA THR ITS SECRETARY AND OTHERS

Disposal
DISPOSED OFF

Holding

The petitioners are entitled to the additional increment as per the 12‑12‑2000 Government Circular, and the respondents must consider their claim and award the increment within six months.

Summary

The petitioners, teachers awarded the Adarsh Shikshak Puraskar, claimed that the additional increment promised under Government Circular dated 12‑12‑2000 had not been paid and that the respondents had taken no cognizance. The High Court observed that their grievance fell within the scope of its earlier order in Writ Petition No. 1954 of 2018. Relying on that precedent, the Court directed the Zilla Parishad (Respondent No. 5) to verify the petitioners’ status as district awardees and to process the additional increment on its merits, expeditiously and preferably within six months. The Court thereby disposed of both writ petitions with the specified direction, granting the relief sought.

Issues considered

  • What entitlement, if any, do teachers awarded the Adarsh Shikshak Puraskar have to the additional increment under the 12‑12‑2000 Government Circular?
  • Whether the respondents are bound to consider and grant the increment within a stipulated period?

                                      DATE : 23rd SEPTEMBER, 2026

              PER COURT :

              1. The grievance of the petitioners is that though the

petitioners are awarded “Adarsh Shikshak Puraskar” and additional

one increment is entitled to them, the same is not given. No

cognizance is also taken by the respondents of the same. The

respondents be directed to give benefit of one advance increment

              as per Circular dated 12.12.2000.

2. Indisputably the case of petitioners is squarely covered

by the order passed by this Court dated 25.01.2019 in Writ Petition

No.1954 of 2018 and connected matters.

3. For the reasons recorded in the said order, both the writ

petitions are disposed of with following direction:

      (I) Respondent No. 5 Zilla Parishad after confirming themselves
of the Petitioners being District Awardee Teachers and
awarded certificates prior to 04.09.2018 shall consider the
case of the Petitioners for additional increment as is laid down
under the Government Circular dated 12.12.2000. The same
shall be considered on its own merits as expeditiously as
possible and preferably within a period of six months.
