MOTILAL OSWAL HOME FINANCE LTD.versusTHE STATE OF MAHARASHTRA, TAHSILDAR, AND ORS

Decided
Disposal
Disposed Off

Holding

The petition is disposed of as the respondents have complied with the earlier order and possession has been handed over to the petitioner.

Summary

The petitioners, Motiwal Oswal Home Finance Ltd., sought enforcement of an earlier order directing the respondents to hand over physical possession of a property. The High Court noted that the order dated 25.08.2026 had been complied with and possession was transferred to the petitioner. Consequently, the Court found no further relief necessary and disposed of the writ petition. The Court also directed the senior police inspector to act on a separate trespass complaint filed by the petitioner in 2025. The disposition reflects the completion of the relief sought and the closure of pending applications.

Issues considered

  • Whether the respondents complied with the earlier court order to hand over possession of the subject property.
  • Whether the petitioner is entitled to a further order after compliance with the earlier order.
  • Whether the petition should be dismissed on the ground of complete satisfaction of the relief sought.

Subjects

  • possession
  • writ petition
  • compliance
