ZIYAURRAHMAN MOHAMMAD ISHAQUE AND ORSversusTHE MALEGAON MUNICIPAL CORPORATION AND ORS
- Decided

Holding
The Court directed the respondents to decide the petitioners' complaint within three months and disposed of the writ petition without adjudicating its merits.
Summary
The petitioners filed a writ petition seeking mandamus to compel the Malegaon Municipal Corporation to remove encroachments and unauthorized constructions on Survey No.122/1, which is part of reservation sites under the Maharashtra Regional and Town Planning Act, 1966 and the Maharashtra Municipal Corporation Act, 1949. They alleged that a complaint dated 7 January 2026 had been ignored by the authorities. The Court, after hearing counsel, declined to entertain the merits of the petition and instead ordered the respondents to decide the pending complaint within three months, giving a hearing to all stakeholders. The Court directed the respondents to act expeditiously if no legal impediment existed. Consequently, the writ petition was disposed without addressing the substantive issues. All contentions of the parties remain open for future consideration.
Issues considered
- Whether the High Court can issue a writ of mandamus directing a municipal corporation to remove encroachments and enforce statutory development plans.
- Whether the petition merits adjudication or can be disposed by directing the authorities to consider the pending complaint.
- Whether the Court may order a time‑bound decision on the petitioners' complaint without examining the substantive merits.
