Bombay High Court
GAJANAN SANJABRAO DARADEversusBABASAHEB AMBEDKAR MARATHWADA UNIVERSITY THR ITS VICE CHANCELLOR AND OTHERS
- Disposal
- DISPOSED OFF
Holding
The court held that the petitioners are entitled to a one‑month extension for thesis submission upon depositing Rs 1 lakh each, and the order will be revoked if they fail to submit within the extended period.
Summary
The petitioners, a group of university students, sought a one‑month extension for submitting their theses, conditioning the extension on a security deposit of Rs 1 lakh each. The University had refused the extension without such deposit. The High Court, relying on its earlier order in Writ Petition No. 6661 of 2026, allowed the writ petitions and directed the University to grant the extension upon receipt of the deposit within a week. The order was made absolute, with a clause that it would be revoked if the petitioners failed to submit their theses within the stipulated period. The judgment emphasizes the court’s power to impose conditions for granting relief in educational matters. The petitioners were required to comply with the deposit and submission timeline, failing which the order would stand revoked.
Issues considered
- Whether a university may deny an extension of time for thesis submission without requiring a security deposit.
- Whether the court can condition the grant of an extension on the deposit of a specified sum.
- Whether the court’s order can be made absolute and subject to revocation upon non‑compliance.
