The Sub‑Registrar cannot insist on a fresh NOC for subsequent sale deeds of the same property once the SIT has issued an NOC.

Summary

The petitioners, Fusion Properties, filed a writ petition seeking a direction that the Sub‑Registrar of Mapusa should not require a fresh No‑Objection Certificate (NOC) from the Special Investigation Team (SIT) for each sale deed concerning the property surveyed as No. 426/15, Anjuna village. The SIT had already issued an NOC on 23 June 2026, and the petitioners argued that this should suffice for any subsequent registration of the same property. The respondents contended that the Sub‑Registrar could still demand a fresh NOC for each transaction. The Court recorded a statement from the Sub‑Registrar accepting that, in view of the prior SIT communication, no fresh NOC would be required for the sale deed the petitioners intended to execute. Accordingly, the Court disposed of the petition. The decision rests on the principle that a single NOC issued by the investigating authority is binding on the registration office for the same property.

           P.C.

Statement is recorded on behalf of the Sub Registrar of
Mapusa that, since SIT has already been communicated by
communication dated 23.6.2026, that NOC for registration of the
sale deed with regard to the property surveyed under No. 426/15 of
village Anjuna, the Sub-Registrar shall not insist on fresh NOC
from the SIT for every sale deed registered in relation to this
property. The statement made is accepted. It is expected that the
Sub-Registrar shall not insist upon the NOC with regard to the sale
deed which the Petitioner wishes to execute in respect of the
property under Survey No. 426/15 of village Anjuna.
