THE MUNICIPAL CORPORATION GREATER MUMBAIversusYUSUF RAHIMATULLA KHANDEWANI AND ANR

The decree in LC Suit No. 756/2009 is not stayed, and the application to dismiss the execution petition is misconceived, leading to dismissal of the writ petition.

Summary

The Municipal Corporation Greater Mumbai filed a writ petition challenging an order dated 28 August 2026 that dismissed its application to quash an execution petition. The petition relied on a prior SLP (C) No. 5056/2014 where the decree holders were allowed to seek alternate accommodation, which the corporation claimed had been rejected. The court noted that the decree from LC Suit No. 756/2009 remains in force and has not been stayed by the first appellate court, rendering the application to dismiss the execution petition misconceived. Consequently, the writ petition was dismissed. The court also imposed costs of Rs.25,000 on the petitioner to be deposited with the Maharashtra State Legal Services Authority.

Issues considered

  • Whether the order dismissing the application to quash the execution petition is valid.
  • Whether the decree in LC Suit No. 756/2009 is stayed or remains operative.
  • Whether the petitioner's reliance on SLP (C) No. 5056/2014 affects the execution proceedings.

August, 2026 passed by the learned Judge, City Civil Court

whereby an application preferred by the petitioner to dismiss

the execution petition, came to be dismissed.

                      3. The said application was filed on the premise that, in SLP
