Bombay High Court
SAKHARCHAND BABURAO SHELARversusSTATE OF MAHARASHTRA THROUGH SECRETARY AND OTHERS
- Disposal
- DISPOSED OFF
Holding
The Court permitted the withdrawal of the writ petitions and ordered them to be disposed of as withdrawn.
Summary
The petitioners filed multiple writ petitions challenging the finalization of tenders and later sought the Court's permission to withdraw those petitions in order to pursue the remedy provided under Clause 55 of the tender document. The Court considered whether such withdrawal was permissible and what procedural consequences would follow. It granted the petitioners' request, ordering the writ petitions to be disposed of as withdrawn. The Court further directed that the tenders not be finalized until the petitioners' objections are decided. It imposed a deadline of fifteen days from the filing date for the resolution of those objections. The order effectively pauses the tender process pending the outcome of the pending objections.
