Bombay High Court
SANDIP PRADIP DESLEversusSTATE OF MAHARASHTRA THROUGH SECRETARY AND OTHERS
- Disposal
- DISPOSED OFF
Holding
The writ petitions are disposed of as withdrawn, and the tenders shall not be finalized until the petitioners' objections are decided within fifteen days.
Summary
A group of ten petitioners filed separate writ petitions challenging the finalization of tenders issued by the State of Maharashtra. The petitioners sought relief, arguing that their objections under Clause 55 of the tender document had not been considered. The petitioners later requested permission to withdraw the writ petitions in order to pursue the remedy available under the said clause. The High Court granted the withdrawal, disposing of the petitions as withdrawn. The Court further ordered that the tenders not be finalized until the petitioners' objections are decided, directing that the decision be made within fifteen days of filing. This order preserves the petitioners' right to seek redress under the tender provisions while staying the administrative action pending resolution of their objections.
