Holding
The Court permitted the withdrawal of the writ petitions and stayed the finalization of the tenders until the petitioners' objections are decided within fifteen days.
Summary
A group of ten petitioners filed separate writ petitions in the Bombay High Court challenging the finalization of tenders issued by the State of Maharashtra. The petitioners sought the Court's permission to withdraw their writ petitions so that they could pursue the remedy provided under Clause 55 of the tender document. The Court examined whether the petitioners were entitled to withdraw the writs and what procedural effect such withdrawal would have on the pending tenders. It held that the petitioners could be allowed to withdraw the writs and that the tenders should remain pending until the petitioners' objections are resolved. Accordingly, the Court granted permission to withdraw, disposed of the writ petitions as withdrawn, and ordered that the tenders not be finalized until the objections are decided within fifteen days.
Issues considered
- Whether petitioners may withdraw pending writ petitions in order to avail a contractual remedy under Clause 55 of the tender document.
