Bombay High Court

RAVINDRA JAGANNATH PATILversusSTATE OF MAHARASHTRA THROUGH SECRETARY AND OTHERS

Disposal
DISPOSED OFF

Holding

The Court permitted the withdrawal of the writ petitions and disposed of them as withdrawn, while staying finalization of the tenders until the petitioners' objections are decided within fifteen days.

Summary

A group of petitioners filed multiple writ petitions in the Bombay High Court challenging actions of the State of Maharashtra related to a tender process. The petitioners later sought the Court's permission to withdraw their petitions so that they could pursue the remedy provided under Clause 55 of the tender document. The Court examined whether a writ petition may be withdrawn at the petitioners' request and what interim effect such withdrawal should have on the pending tender. It granted permission to withdraw the petitions and ordered that the writ petitions be disposed of as withdrawn. The Court further directed that the tenders not be finalized until the petitioners' objections are decided, setting a 15‑day deadline for that determination. No substantive merits of the original claims were adjudicated as the petitions were withdrawn.

Issues considered

  • Whether a petitioner may be allowed to withdraw a writ petition after filing.
