The petitioners are entitled to the one‑step pay‑scale benefits, and the authorities must implement the same as directed.
Summary
A group of writ petitions filed by employees working in Tribal and PESA areas of Maharashtra sought the implementation of the one‑step pay‑scale (Eksthar) benefits as per the Government Resolution dated 29‑02‑2024. The petitioners argued that they were similarly situated to those in Writ Petition No. 248 of 2026, where the Court had already granted such relief. The Court examined the earlier order and found that the issues were identical, directing the Zilla Parishad Education Officer to verify the petitioners’ records within 30 days and, where no legal impediment existed, to pay the one‑step salary benefits and arrears. If any petitioner is found ineligible, a notice and hearing within 120 days are to be conducted before a final order is passed. Consequently, the Court allowed all the writ petitions and issued detailed implementation directions.
Issues considered
- Whether employees deployed in Tribal and PESA areas are entitled to the one‑step pay‑scale benefits under the Government Resolution dated 29‑02‑2024.
- Whether the authorities must retrospectively pay arrears and current salary adjustments to eligible petitioners.
