- Disposal
- Rule made absolute
Holding
The Court directed the CEO to verify the application by 9 Oct 2026 and the ECI to decide the registration, after hearing the parties, by 30 Nov 2026, thereby disposing of both petitions.
Summary
Petitioner Girish Chodankar filed Writ Petition No.1118/2026 seeking a mandamus directing the Election Commission of India (ECI) to consider his objections to the registration of a new political party called "Goa Congress Party". In Writ Petition No.1277/2026, Francisco Antonio Gouveia applied under Section 29A of the Representation of the People Act, 1951 for registration of the same party. The Court examined the statutory procedure under Sections 29A, 2D and 8 of the Act, including the role of the Chief Electoral Officer (CEO) of Goa in verifying the application and the requirement to consider objections. It directed the CEO to complete verification by 9 October 2026 and the ECI to decide the application, after hearing both the applicant and objector, within 15 days of receiving the CEO’s report and no later than 30 November 2026. The orders were made absolute and both writ petitions were disposed of.
Issues considered
- Whether the Election Commission of India must entertain objections raised against the registration of a political party under Section 29A of the Representation of the People Act, 1951.
- Whether the Chief Electoral Officer of Goa is required to verify the application and report within a specified time frame.
- Whether the ECI must decide the registration application within the timeline prescribed by the Act after considering all objections.
