The order refusing to reject the plaint under Order VII Rule 11 is upheld, as the objections pertain to factual issues that must be resolved by evidence and the plaint cannot be dismissed for non‑payment of fees at this stage.
Summary
The petitioners filed a writ petition challenging the order of the 5th Joint Civil Judge Senior Division, Jalgaon, which had refused to reject the plaint in Special Civil Suit No. 186 of 2025 under Order VII Rule 11 of the CPC. They alleged that the first defendant was not the legal wife of the deceased and that the plaint was filed without payment of court fees under Section 46 of the Maharashtra Court Fees Act. The trial judge held that these matters involved factual disputes that must be decided on evidence and that a plaint cannot be dismissed for non‑payment of fees at the pleading stage. The High Court agreed, finding no irregularity in the lower court’s application of Order VII Rule 11 and the Court Fees Act, and noted that the respondent had produced an heirship certificate to support her claim. Accordingly, the writ petition was dismissed.
Issues considered
- Whether the status of the respondent as the legal wife of the deceased can be a ground for rejecting the plaint under Order VII Rule 11 of the CPC.
- Whether non‑payment of court fees under Section 46 of the Maharashtra Court Fees Act warrants rejection of the plaint at the pleading stage.
