Bombay High Court

BASANTI RAMESH SULANEversusTHE DISTRICT SUPERITENDENT OF POLICE AND OTHERS

Disposal
DISPOSED OFF

Holding

The writ petition stands disposed, with the petitioner permitted to file a protest petition against the pending ‘B’ summary.

Summary

The petitioner, Basanti Ramesh Sulane, filed a criminal writ petition seeking the addition of offences under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act to Crime No. 225/2023 registered at Sillegaon Police Station. The petition also requested an adjournment. The Court observed that a ‘B’ summary had already been filed in the case and was pending final decision in the concerned trial court. Considering the pending summary, the Court declined to grant an adjournment and disposed of the writ petition, granting the petitioner liberty to challenge the ‘B’ summary by filing a protest petition. Consequently, the writ petition was dismissed as moot pending the outcome of the pending summary.

Issues considered

  • Whether the petitioner’s request to add offences under the SC/ST (Prevention of Atrocities) Act can be entertained through a criminal writ petition.
  • Whether the Court should grant an adjournment in view of the pending ‘B’ summary in the trial court.
  • Whether the petitioner may challenge the ‘B’ summary by filing a protest petition.
