BHIMA RAMA KORAVIversusTHE STATE OF MAHARASHTRA AND OTHERS

Disposal
Disposed Off

Holding

The petition is premature and is therefore disposed of.

Summary

The petitioner, Bhima Rama Koravi, filed a writ petition challenging the legality and validity of a notice of hearing dated 4 April 2025 issued by the Residential Deputy Collector, Kolhapur, requiring his appearance on 15 April 2025. The petitioner could not explain what transpired after the hearing date and sought relief from the court. The Court held that the petition was premature, directing the petitioner to appear before the authority, file a detailed reply, and thereafter approach the courts if necessary. The Court also noted that the authority should consider an earlier award dated 29 April 2000 in Land Reference No.17 of 1980 relied upon by the petitioner. All contentions were kept open, and the petition was disposed of.

Issues considered

  • Whether the notice of hearing dated 4 April 2025 issued by the Residential Deputy Collector is legally valid.
