Holding
The petition is disposed of with specific procedural directions for the petitioner to submit fresh documentation and for the respondents to assess and, if appropriate, release the reimbursement under the RTE Act.
Summary
The petitioner, Sarthi Shikshan Prasarak Mandal, filed a writ petition seeking reimbursement of fees paid for students admitted under the 25% quota mandated by the Right of Children to Free and Compulsory Education Act, 2009. The Court allowed the amendment of the petition to include the State of Maharashtra as an additional respondent and set a detailed timetable for the petitioner to submit fresh documentation and for the respondents to process the claim. The Zilla Parishad, Pune was directed to verify the documentation, forward recommendations to the State, and ultimately release any admissible amount to the petitioner within specified deadlines. The Court also ordered that if the petitioner is found ineligible for reimbursement, a reasoned order must be issued, allowing the petitioner to seek further redress. The petition was disposed of with these compliance directions and no order as to costs.
Issues considered
- Whether the petitioner is entitled to reimbursement of fees under the RTE Act for students admitted under the 25% quota.
