The petition is disposed with procedural directions for the school to submit a fresh claim and for the authorities to determine and release any reimbursement, without a substantive ruling on entitlement.
Summary
The Bhimabai Sopanrao Upadhye English Medium School filed a writ petition seeking reimbursement of fees paid for students admitted under the 25% quota mandated by the Right of Children to Free and Compulsory Education Act, 2009. The Court noted a prior order in City International School Kothrud v. State of Maharashtra and, rather than deciding the substantive entitlement, directed the school to submit a fresh, properly formatted communication with supporting documents within a week. The Zilla Parishad, Pune was ordered to seek any further information from the school, forward its recommendations to the State, and the State to determine eligibility and quantum of reimbursement by specified dates. The State was further directed to release the approved amount to the Zilla Parishad, which in turn must pay the school within a set timeline. If the school is found ineligible, a reasoned order must be issued, and the petition was disposed with these procedural directions and no order on costs.
Issues considered
- What is the entitlement of a school to reimbursement of fees for students admitted under the 25% quota under the RTE Act?
- Whether the petitioner has complied with the procedural requirements for claiming such reimbursement.
