The petition is disposed with directions for the school to submit fresh documentation and for the Zilla Parishad and State to follow a detailed timeline to determine and release any reimbursement, without a substantive determination of entitlement.

Summary

The petitioner, SPG International Public School, filed a writ petition seeking reimbursement of fees paid for students admitted under the 25% quota mandated by the Right of Children to Free and Compulsory Education Act, 2009. The Court, after noting a prior order in City International School Kothrud v. State of Maharashtra, directed the school to submit a fresh communication with supporting documents to the Zilla Parishad, Pune within a week. The Zilla Parishad was ordered to seek any further compliance from the school, forward its recommendations to the State, and the State to determine eligibility and quantum of reimbursement within prescribed timelines. The State was further directed to release the admissible amount to the Zilla Parishad, which in turn must pay the school, all within specific dates. If the school is found ineligible, a reasoned order must be issued. The petition was disposed with these procedural directions and no order on costs.

Issues considered

  • What is the entitlement of a private school to reimbursement of fees for students admitted under the 25% quota under the RTE Act, 2009?
  • What procedural steps must be complied with before any reimbursement can be determined and released?
