The Court ordered the State to independently scrutinize the institutions' reimbursement proposals and, if entitlement is established, to disburse the fees within the stipulated time‑frames.
Summary
Several educational institutions filed writ petitions seeking reimbursement of fees paid for students admitted under the Right of Children to Free and Compulsory Education Act, 2009. The petitioners argued that the State of Maharashtra was obligated to refund these fees but had not done so. The State contended that the reimbursement claims required proper scrutiny and that no specific statutory provision mandated automatic payment. The Court examined the provisions of the RTE Act and held that the State must examine each institution's claim on its merits and, if justified, reimburse the fees. Accordingly, the Court directed the respondent authorities to complete an independent scrutiny of the proposals within four weeks and to disburse any amounts due within a further four weeks. The writ petitions were disposed of with these directions.
Issues considered
- Whether the State of Maharashtra is liable to reimburse fees paid by institutions for students admitted under the Right of Children to Free and Compulsory Education Act, 2009
