The Court ordered the State authorities to scrutinise the institutions' reimbursement proposals independently and, if found eligible, to disburse the amounts within stipulated time‑frames.
Summary
Several educational institutions filed writ petitions seeking reimbursement of fees paid for students admitted under the Right of Children to Free and Compulsory Education Act, 2009. The petitioners argued that they were entitled to such reimbursement from the State of Maharashtra. The State contended that the reimbursement process required proper scrutiny of the institutions' proposals. The High Court directed the respondent authorities to independently examine the proposals on their merits and decide within four weeks of receiving the order, and to disburse any awarded reimbursement within a further four weeks. No substantive adjudication on entitlement was made; the matter was remanded for administrative determination. Consequently, the petitions were disposed with directions for prompt action.
