Holding

The petition is disposed with directions for the school to submit a fresh claim in the prescribed format and for the respondents to follow a stipulated timeline to determine and release any reimbursement.

Summary

Cygnet Public School New, Narhe filed a writ petition seeking reimbursement of fees paid by students admitted under the 25% quota mandated by the Right of Children to Free and Compulsory Education Act, 2009. The school had earlier submitted its claim to the Zilla Parishad, Pune, but the court required a fresh, properly formatted communication with supporting documents. Relying on its earlier order in City International School Kothrud v. State of Maharashtra, the court prescribed a detailed timeline for the school and the respondents to exchange documents, make recommendations, determine eligibility, and release any payable amount. The court also directed that if the school is found ineligible, a reasoned order must be issued. The petition was disposed with these procedural directions and no order on costs.

Issues considered

  • What is the entitlement of a school to reimbursement of fees under the RTE Act for students admitted under the 25% quota?
  • Whether the school has complied with the procedural requirements for claiming reimbursement?
  • Whether the respondents must determine eligibility and quantum of reimbursement within the prescribed timeline?
