The Court did not adjudicate the substantive entitlement but ordered the parties to follow a prescribed procedure and timeline to determine and, if applicable, release the reimbursement.
Summary
Prodigy Public School, through its principal, filed a writ petition seeking reimbursement of fees paid for students admitted under the 25% quota mandated by the Right of Children to Free and Compulsory Education Act, 2009. The school had earlier submitted a claim with the Zilla Parishad, Pune, but the High Court directed that a fresh application with supporting documents be filed within a week. The Court, relying on its earlier order in City International School Kothrud v. State of Maharashtra, prescribed a detailed timeline for the Zilla Parishad to seek compliance, forward recommendations to the State, and for the State to determine eligibility and release the amount. If the school is found ineligible, a reasoned order must be issued, allowing the school to pursue other remedies. The Court disposed of the petition with these procedural directions and ordered no costs. The order emphasizes strict adherence to the timeline and procedural compliance before any substantive determination on reimbursement.
Issues considered
- Whether the school is entitled to reimbursement of fees under the RTE Act for students admitted under the 25% quota
