FLORIDA ENGLISH SCHOOL THRU PRINCIPAL MAHADEV DYANESHWAR KODREversusTHE STATE OF MAHARASHTRA THRU SECRETARY AND ORS

The Court directed the petitioner to submit a fresh claim with documents and ordered the respondents to process the reimbursement claim within specified timelines, thereby providing procedural relief but not adjudicating the substantive entitlement.
Summary
The Florida English School filed a writ petition seeking reimbursement of fees paid for students admitted under the 25% quota mandated by the Right of Children to Free and Compulsory Education Act, 2009. The petitioners had earlier submitted representations to the Zilla Parishad, Pune, but the Court directed them to file a fresh communication with supporting documents within a week. The Court then prescribed a detailed timetable for the Zilla Parishad and the State of Maharashtra to verify eligibility, determine the quantum of reimbursement, and release the funds, with strict deadlines. If the school is found ineligible, a reasoned order must be issued. The Court disposed of the petition subject to compliance with these directions and ordered no costs.
Issues considered
- Whether the Florida English School is entitled to reimbursement of fees for students admitted under the 25% RTE quota.
- What procedure and timeline should be followed by the Zilla Parishad and the State for processing such reimbursement claims.
