The court ordered the petitioner to submit a fresh claim in the prescribed format and directed the respondents to determine eligibility and, if applicable, release the reimbursement within the stipulated timelines.

Summary

The Bombay High Court heard a writ petition filed by Balaji Prathamik and Madhyamik Vidyalay seeking reimbursement of fees paid for students admitted under the 25% quota mandated by the Right of Children to Free and Compulsory Education Act, 2009. The school had previously submitted its claim to the Zilla Parishad, Pune, but the court directed that a fresh communication in the prescribed format be filed along with supporting documents. The court, relying on an earlier decision in City International School Kothrud v. State of Maharashtra, set a detailed timetable for the Zilla Parishad to seek recommendations, for the State to determine eligibility and quantum of reimbursement, and for the release of funds. It also ordered that if the school is found ineligible, a reasoned order must be issued. The petition was disposed of with these procedural directions and no order as to costs.

Issues considered

  • What entitlement, if any, does a school have to reimbursement of fees under the RTE Act for students admitted under the 25% quota?
  • What procedural steps must be followed by the school and the responding authorities to process such a reimbursement claim?
