Holding

The Court held that monetary benefits from the pay‑scale extension are limited to the three years preceding the filing of the petition and that the petitioners are entitled to dearness allowance, with the benefits to be released within twelve weeks of the order.

Summary

The petitioners, Rajendra Subhash Kanwade and others, filed a writ petition before the Bombay High Court seeking monetary benefits arising from an extension of their pay scale and entitlement to dearness allowance. The respondents, the State of Maharashtra, contested the extent and timing of such benefits. The Court referred to its earlier decision in Writ Petition No. 14725 of 2017, which addressed the same issue. It held that the monetary benefits are confined to the three years preceding the filing of the present petition, i.e., up to 22 September 2023. The petitioners were affirmed to be entitled to dearness allowance on the minimum admissible pay scale. The Court ordered that the pecuniary benefits be released to the petitioners within twelve weeks of the order’s upload. Consequently, the petition was disposed of on these terms.
