The Court directed a specific procedural timeline for the schools to claim reimbursement and for the State and Zilla Parishad to determine and release any eligible amounts, with a provision for a reasoned order if no entitlement is found.
Summary
A group of private schools filed writ petitions seeking reimbursement of fees paid for students admitted under the 25% quota mandated by the Right of Children to Free and Compulsory Education Act, 2009. The High Court, recalling its earlier order in Sanskar Primary and High School Pune v. State of Maharashtra, directed the schools to submit fresh applications with supporting documents to the Zilla Parishad, Nashik within a week. The Zilla Parishad was ordered to seek any further information from the schools, forward its recommendations to the State authorities, and the State was to determine eligibility and quantum of reimbursement by 31 December 2026. Upon determination, the State must release the amount to the Zilla Parishad, which in turn must pay the schools by 21 January 2027. If a school is found ineligible, a reasoned order must be issued, allowing the school to pursue other legal remedies. The petition was disposed with the procedural timetable and no costs awarded.
