Bombay High Court
AMIT LALKHA TADVIversusTHE STATE OF MAHARASHTRA AND OTHERS
- Disposal
- Withdrawn
Holding
The petition is disposed of as withdrawn, with liberty to the petitioner to make a fresh parole application after surrender.
Summary
Amit Tadvi filed Criminal Writ Petition No. 1317 of 2026 seeking parole. The petitioner later requested permission to withdraw the petition and to surrender, asking for liberty to file a fresh parole application thereafter. The State, through its A.P.P., indicated that surrender should precede any new parole application, which would be considered on its merits and preferably decided before 10 September 2026. The Bench considered whether the court could grant such permission and set a timeline. The Court allowed the withdrawal, granting the petitioner liberty to make a fresh parole application after surrender, and ordered that any such application be decided on its merits within the stipulated period. No substantive merits of the parole request were adjudicated.
