Holding

The Court did not decide the substantive entitlement but ordered the parties to follow a prescribed procedure and timeline for determining and, if applicable, releasing the reimbursement.

Summary

Buds International School filed a writ petition seeking reimbursement of fees paid by students admitted under the 25% quota mandated by the Right of Children to Free and Compulsory Education Act, 2009. The school claimed that the State of Maharashtra and the Zilla Parishad, Pune, were liable to refund the amounts collected. The Court, recalling its earlier order in City International School Kothrud v. State of Maharashtra, directed the school to submit a fresh, properly formatted communication with supporting documents within a week. It then set a detailed timetable for the Zilla Parishad and the State to examine the claim, determine eligibility, and release any payable amount, with strict compliance deadlines. The petition was disposed with these procedural directions, and no substantive determination on the school’s entitlement was made.
