Disposal
Disposed Off

Holding

The petition is infructuous and both the writ petition and the interim application are disposed of.

Summary

Smt. Manisha Baban Bhujabal filed a writ petition seeking relief against the State of Maharashtra and others. She was subsequently reinstated, rendering the petition allegedly infructuous. The petitioner also filed an interim application seeking reliefs that were not part of the original writ petition. Counsel argued that the petition should be dismissed as the relief sought had already been granted and that the interim application was outside the petition's scope. The Court agreed, holding that the petition was no longer maintainable and that the interim application could not be entertained. Consequently, both the writ petition and the interim application were disposed of.

Issues considered

  • Whether the writ petition remains maintainable after the petitioner’s reinstatement?
  • Whether the interim application seeking reliefs outside the scope of the writ petition can be entertained?

                                                  Date : SEPTEMBER 11, 2026
               P. C. :

               1. Learned counsel for the Petitioner would submit that the Petition

has been rendered infructuous, as she has already been reinstated.

Though, an Interim Application has been filed, the application seeks

reliefs, which were not the subject matter of the Writ Petition. It is open

for the Petitioner to adopt independent proceedings to seek reliefs

               consequential to her reinstatement.

               2. The Petition and Interim Application are accordingly disposed of.

                [NEERAJ P. DHOTE, J.] [SHARMILA U. DESHMUKH, J.]
