The Court held that the State CET Cell must include the petitioner college in the seat matrix as the State had granted continuation of its conditional affiliation for the 2026‑2027 academic year.
Summary
The Marathwada Mitra Mandal’s College of Physiotherapy filed a writ petition seeking inclusion in the seat matrix for the Common Admission Process (CAP) rounds for the 2026‑2027 academic year. The college had been omitted from the matrix issued by the State CET Cell, prompting an urgent petition. Respondent No.3, Maharashtra University of Health Sciences, produced a letter dated 6 October 2026 indicating that the State had decided to grant continuation of the college’s conditional affiliation with the previously sanctioned intake. The Court examined whether the CET Cell could be directed to incorporate the college in the seat matrix in light of the State’s decision. Relying on the State’s explicit instruction, the Court ordered the CET Cell to include the college, thereby enabling its participation in the CAP rounds. The petition was disposed without any order as to costs.
Issues considered
- Whether the petitioner college is entitled to be included in the CAP seat matrix despite its earlier exclusion.
- Whether the High Court can direct the State CET Cell to modify the seat matrix based on the State’s decision to continue the college’s conditional affiliation.
