RIZWAN RASHID SHAIKHversusTHE STATE OF MAHARASHTRA AND ORS

Decided
Disposal
Dismissed as Withdrawn

Holding

The petition remains dismissed as withdrawn, and no further orders are required after compliance with the cost payment.

Summary

The petitioner, Rizwan Rashid Shaikh, filed a writ petition in the Bombay High Court. On 21 August 2026, the Court dismissed the petition as withdrawn after the petitioner agreed to pay Rs.1,00,000 to Respondent No.2, citing manipulation of the record. The Court set a compliance date of 28 August 2026. On 31 August 2026, the petitioner claimed the cost payment had been made. The Court noted that the petition had already been dismissed as withdrawn and, with the cost complied, ordered no further action. The petition remains dismissed.

P. C.:

1. This Court passed the following order on 21st August, 2026 :-

“1. After arguing the matter for considerable time,
learned counsel appearing for the petitioner, on
instructions from the petitioner, seeks withdrawal of
the petition. However, as factual position on record
clearly shows that the petitioner has manipulated the
record, the petitioner who is present in Court states
that he will pay cost of Rs.1,00,000/- to Respondent
No.2 within a period of one week from today.

         2. Accordingly, writ petition is dismissed as
         withdrawn.

         3. Stand over to 28 August 2026 at 3:00 p.m. to ensure
         compliance of this order.”
