The order dated 02.02.2026 placing the petitioner under Category 2(c) is set aside and the petitioner must be placed under Category 3(b) of the 2010 Guideline.
Summary
Krushna Devidas Haleghongde filed a criminal writ petition seeking the quashment of an order dated 02.02.2026 that placed him under Category 2(c) of the 2010 Guideline and requested placement under Category 3(b). He relied on a prior judgment of this Court in Criminal Writ Petition No. 364 of 2026, where the same order was set aside for his father. The Bench examined the earlier precedent and held that the impugned order was common to the petitioner and therefore should meet the same fate. The Court quashed the order dated 02.02.2026 and directed the respondents to re‑classify the petitioner under Category 3(b) within 15 days. The petition was allowed and disposed of.
Issues considered
- Whether the order placing the petitioner under Category 2(c) of the 2010 Guideline is valid.
- Whether the petitioner is entitled to be re‑classified under Category 3(b) in view of the earlier judgment in Criminal Writ Petition No. 364 of 2026.
