Bombay High Court

AKIL KHALIK PEERJADEversusSECURITY PRINTING AND MINTING CORPORATION OF INDIA LIMITED AND ORS

Decided
Disposal
Disposed Off

Holding

The Court disposed of the petition, granting liberty to withdraw it and file a fresh petition, and held that interim relief restraining the disciplinary action cannot be granted at this stage.

Summary

The petitioner, Mr. Akil Khalik Peerjade, sought a decision on a pending appeal against a disciplinary action dated 10 October 2025. He claimed to have received an undated order, purportedly signed on 3 January 2026, indicating that the appeal had been decided. The petitioner wished to challenge both the appeal decision and the disciplinary action by filing a composite writ petition. The High Court granted him leave to withdraw the present petition and file a fresh one, disposing of the current petition with liberty as prayed. The Court observed that, following the Supreme Court’s decision in Hindustan Lever Ltd. v. Ashok Vishnu Kate (1996 AIR 285), interim relief restraining the authority from effecting the disciplinary action could not be granted at this stage. The Court further noted that if a fresh petition succeeds, the petitioner would be entitled to all benefits, including consequential monetary benefits.

Issues considered

  • Whether interim relief restraining the authority from effecting a disciplinary action can be granted at the interim stage.
  • Whether the petitioner may withdraw the present writ petition and file a fresh composite petition challenging the appeal decision and disciplinary action.
