Bombay High Court

GODAWARI GANGADHAR DARBASTWAR ALIAS JAISHRI ASHOKRAO KUNTURKARversusTHE STATE OF MAHARASHTRA THROUGH ITS SECRETARY AND OTHERS

Disposal
DISPOSED OFF

Holding

The petition was disposed by the court on the basis of a compromise entered into between the petitioner and respondents 4 and 5.

Summary

The petitioner, Godawari Gangadhar Darbastwar, filed a writ petition challenging the non-payment of salary and pension for the period June 2010 to February 2021. Respondents 4 and 5 submitted a salary and pension proposal to the District Social Welfare Officer (respondent 3). The parties reached a compromise, which the Court accepted and ordered that the proposal be processed and sanctioned on its own merit without further delay. The Court clarified that the compromise settlement governs the disposal of the writ petition. Consequently, the petition was dismissed in terms of the compromise, and the administrative authorities were directed to act expeditiously.

Issues considered

  • Whether the petitioner is entitled to salary and pension for the period June 2010 to February 2021.
  • Whether the Court can order processing of the salary‑pension proposal on its own merit after a compromise.
  • Whether a compromise between the parties is permissible and sufficient to dispose of a writ petition.
