The Court declined to grant the writ of mandamus and instead ordered the petitioners to make representations to the designated officer, after which a hearing would be conducted.

Summary

The petitioners, junior engineers employed by the Pune Municipal Corporation, filed a writ petition under Article 226 seeking mandatory promotion to higher posts, seniority, and arrears, alleging that the corporation had violated their promotion rights. They also requested the court to direct the corporation to schedule the Departmental Promotion Committee (DPC) for the 2021‑22 eligible candidates and to stay any further DPC meetings until their grievances were resolved. The respondents argued that the reliefs sought were beyond the scope of judicial intervention. The Court expressed doubt about granting such extensive reliefs and instead permitted the petitioners to make representations to the designated officer of the corporation within two weeks, followed by a hearing and decision within four weeks. All parties' contentions were kept open, and the petition was disposed of without costs.

Issues considered

  • What reliefs, if any, can a High Court grant under Article 226 in matters of alleged denial of promotion and seniority in a public corporation?
  • Whether the court can direct a public corporation to schedule a Departmental Promotion Committee and stay its proceedings pending the petitioner's representations.
