Bombay High Court

RAVI PRAKASHRAO JAWANJALversusTHE STATE OF MAHARASHTRA AND OTHERS

Disposal
DISPOSED OFF

Holding

The petition is dismissed as premature; the petitioner must await the outcome of the pending criminal trial before seeking further proceedings.

Summary

The petitioner, Ravi Prakashrao Jawanjal, filed a criminal writ petition seeking the initiation of an investigation against respondents 4 and 6 for alleged illegal detention and claimed compensation of Rs.10,00,000. The petitioner also alleged that his complaints dated 5 August 2020 and 3 September 2020 were not acted upon. The State contended that the petitioner’s name was absent from the FIR, but the investigation later linked him to Crime No. 283 of 2020, with a trial already pending in Parbhani. The Court held that the petition was premature because the petitioner is himself a co‑accused in an ongoing criminal case. Consequently, the petition was disposed, with liberty to the petitioner to pursue appropriate legal remedies after the pending trial concludes.
