KANTI BUILDERS PVT LTDversusSTATE OF MAHARASHTRA

Decided
Disposal
DISPOSED OFF

Holding

The Court disposed the petition, directing the petitioner to fulfill the pending conditions and the respondents to process the application expeditiously, without issuing the writ of mandamus.

Summary

Kanti Builders Pvt Ltd. filed a writ petition under Article 226 seeking a mandamus directing the State of Maharashtra and the Brihanmumbai Municipal Corporation (BMC) to grant two‑times TDR‑FSI in the form of a Development Right Certificate (DRC) or monetary compensation for land affected by a Nalla widening project at CTS No.374/B/6, Borivali. The petitioner relied on a BMC communication dated 30 September 2025 that conditionally approved the TDR, subject to issuance of a full Completion Certificate by the SWD Department and joint measurement and takeover of the land. The respondents contested the nature of the Completion Certificate, claiming it was only a part completion certificate, and argued that the petitioner must fulfill the remaining conditions before any grant can be made. The Court examined the dispute over the certificate and held that the petitioner must file an application within ten days to satisfy the second and third conditions, after which the competent authority should act expeditiously within two months. Accordingly, the petition was disposed without granting the writ, directing the parties to comply with the procedural requirements.

Issues considered

  • Whether the State and BMC are duty‑bound to grant the TDR/DRC or compensation as sought by the petitioner.
  • Whether the Completion Certificate produced is a full completion certificate or a part completion certificate and its legal effect.
  • Whether a writ of mandamus is the appropriate remedy in the present circumstances.
