Bombay High Court

SURUCHEE D/O MADHUSUDHANSINGH CHOUHANversusSTATE OF MAHARASHTRA THROUGH SECRETARY DEPARTMENT OF HOME

Decided
Disposal
Disposed Off

Holding

The Court disposed of the writ petition as withdrawn on the petitioner’s request, and the pending interim application was also dismissed.

Summary

The petitioner, Suruchee, appeared for the Judicial Examination of 2022 and 2023. A Supreme Court order dated 19.08.2026 in the case of Pratikraj Rajendrakumar Hamand & Ors. v. Nikita Deepakrao More & Ors. granted her the benefits and deemed her selected. Consequently, she filed a writ petition seeking selection in the 2023 process but later moved to withdraw the petition. The Court considered whether the petition could be withdrawn and the effect on the pending interim application. It ordered that the writ petition be disposed of as withdrawn and that the interim application stand disposed. The decision effectively closed the matter in favor of the petitioner’s request.

Issues considered

  • Whether the petitioner may withdraw the writ petition seeking selection after being deemed selected by a Supreme Court order
  • Whether the pending interim application survives the withdrawal of the main petition

Ors. Versus Nikita Deepakrao More & Ors. 1, the Petitioner has received

the benefits and is now deemed to have been selected. Therefore, the

present Petition seeking selection in the 2023 selection process would

not survive, and the Petitioner seeks liberty to withdraw this Petition, is

the contention of the learned Counsel for the Petitioner.

2. In view of the above, this Writ Petition is disposed off as

withdrawn, on instructions.

3. Pending Interim Application would not survive and stands

disposed off.
