All mutation entries are subject to a civil determination of rights between the parties.

Summary

Petitioner Baban Motiram Pawar filed a writ petition challenging the mutation of a property. The Court noted that mutation entries are governed by the outcome of a civil suit determining the parties' rights. It reiterated settled law that mutation can be rectified only after the civil court decides the matter. Consequently, if the petitioner succeeds in the civil suit, he may apply for rectification of the mutation entry. The Court therefore disposed of the writ petition without further order.
