Bombay High Court

AVIATION KARMACHARI SANGHATANAversusTHE AUTHORITY UNDER SECTION

Decided
Disposal
Disposed Off

Holding

The Court permitted the withdrawal of the petition with liberty to adopt appropriate remedies.

Summary

Aviation Karmachari Sanghatana filed a writ petition challenging a reduction in wages and allowances, seeking relief against an order dated 11 June 2025. The petitioner, through counsel, requested leave to withdraw the petition while retaining the liberty to pursue alternative remedies without being bound by the observations of the impugned order. The Court considered whether such a withdrawal could be permitted and whether the petitioner could be freed from the effect of the earlier order. It held that the petitioner could be allowed to withdraw the petition with liberty to adopt appropriate remedies. Consequently, the petition was withdrawn and disposed of by the Court.

Issues considered

  • Whether the petitioner may be granted leave to withdraw the writ petition while preserving the liberty to pursue other remedies.
  • Whether the observations made in the impugned order dated 11 June 2025 would bind any future proceedings initiated by the petitioner.

Subjects

  • withdrawal of petition
  • wage reduction
  • labor union
  • writ petition
  • liberty to adopt remedies
