Disposal
Disposed Off

Holding

The petitioners are covered by the earlier judgments and the writ petition is disposed.

Summary

The petitioners, represented by the Shivaji University Teachers Association, sought confirmation that they are entitled to benefits under two earlier judgments dated 28 June 2023 and 17 November 2023. The petitioners argued that while the benefits have been extended during the pendency of the writ, an individual petitioner might still be excluded. The Court examined the scope of the earlier judgments and concluded that the petitioners are already covered by them. It directed that any remaining individual petitioner who is denied the benefit may approach the University and the concerned authority for relief. Accordingly, the writ petition was disposed.

Mr. C.G. Gavnekar (through VC) a/w Shravan H. Sul for the Petitioners.
Mr. R.P. Kadam, ‘B’ panel counsel for the Respondent - State.

                                                            CORAM : R.G. AVACHAT AND
                                                                        AJIT B. KADETHANKAR, JJ.

                                                            DATE : 6th FEBRUARY, 2026.
                       P. C. :

                       1. Mr. Gavnekar, learned counsel for the petitioners would submit

that the petitioners are squarely covered by the G.R. dated 28th June 2023

and the clarificatory subsequent G.R. dated 17th November 2023. He

would submit that during the pendency of this petition, the petitioners

are already benefited of those G.Rs. However, he apprehends that an

individual petitioner might be left to get such benefit.

                       2. In view of this, purpose of writ petition is served. Accordingly, the

                       Petition stands disposed of.

3. In the event, if any individual petitioner is still deprived of the

benefit of both these G.Rs., he/she is at liberty to file appropriate

representation to the University and concerned Authority. The concerned

Authority as also the University shall extend the benefit to such

employee/s.

4. The Writ Petition stands disposed of.
