Bombay High Court

PARSHURAM SOCIAL AND SPORTS SOCIAL CLUB, THROUGH ITS SECRETARY, SHRIDHAR JAGANNATH MALLEWARversusTHE STATE OF MAHARASHTRA AND OTHERS

Disposal
DISPOSED OFF

Holding

The court held that, in the absence of a renewed license, the petition has no basis and must be dismissed.

Summary

The petitioner, Parshuram Social and Sports Club, filed a criminal writ petition seeking a direction to continue operating its social club under an existing license. The petitioner’s counsel later informed the court that the club's license had not been renewed. The central issue was whether the court could grant relief allowing the club to operate without a valid, renewed license. The court examined the fact that the license renewal was pending and noted that no legal basis existed to grant the requested direction. Consequently, the court concluded that the petition lacked any surviving claim. The petition was therefore disposed of without any order granting the relief sought.
