Bombay High Court

SHARAD S/O. NATHU PATILversusCHIEF EXECUTIVE OFFICER, ZILLA PARISHAD, JALGAON AND OTHERS

Disposal
DISPOSED OFF

Holding

The petition is disposed as there is no remaining relief to grant after the disqualification of the Sarpanch and withholding of the VDO's increments.

Summary

The petitioner, Sharad, filed a criminal writ petition challenging the actions taken against the Sarpanch and Village Development Officer (VDO) of Janve Village Panchayat. The respondents submitted a communication indicating that the Sarpanch's term had ended, a disqualification report had been forwarded, and two increments of the VDO were temporarily withheld. The court examined these annexures and found that appropriate disciplinary actions had already been initiated against the officials. Since the remedial measures were already in place, the petition no longer had any operative relief to grant. Consequently, the court held that there was nothing left to adjudicate and ordered the petition to be disposed of.
