The writ petition is not maintainable as it pertains to a civil dispute and is dismissed as withdrawn.
Summary
The petitioner filed a writ petition under Article 226 seeking various reliefs including a mandamus to declare the police sealing of his premises illegal, restoration of possession, inquiry into police misconduct, transfer of investigation, preservation of CCTV footage, and compensation. The Court observed that the dispute is essentially a civil landlord‑tenant matter involving factual issues that cannot be entertained by a writ jurisdiction. It further noted that the petition was deficient in particulars. The petitioner’s counsel then sought permission to withdraw the petition and to pursue appropriate civil or criminal proceedings. The Court allowed the withdrawal and dismissed the writ petition, granting liberty to institute suitable proceedings elsewhere.
Issues considered
- Whether a writ petition under Article 226 is maintainable when the dispute is purely civil in nature between landlord and tenant.
- Whether the petition, lacking necessary particulars, can be entertained by the High Court.

and to ensure that such electronic evidence is not tampered with or

2. We have heard the learned Counsel for the Petitioner. Having
heard the learned Counsel for the Petitioner and considering the
reliefs sought through the instant Writ Petition, we are of the
considered opinion that the dispute between the parties inter-se
appears to be purely Civil in nature. These are factual disputes
between the Landlord and the Tenant, which cannot be gone into a
writ petition under Article 226 of the Constitution of India.
Moreover, the Petition lacks the necessary particulars.
3. Confronted with the aforesaid situation, the learned Counsel
for the Petitioner, on instructions, seeks leave to withdraw the Writ
Petition with liberty to the Petitioner to institute appropriate
proceedings before the competent Civil/Criminal Court in
accordance with law.
4. In view of the aforesaid submission, the Writ Petition is
dismissed as withdrawn with the aforesaid liberty.
