The petition seeking transfer of investigation to the CID was dismissed as the investigations were already in progress and no relief could be granted.
Summary
The petitioners, Jayshree and another, filed a criminal writ petition seeking a direction to transfer the investigations of Crime No. 642 of 2019 (registered at M.I.D.C. Police Station, Ahmednagar) and Crime No. 133 of 2016 (registered at Tophkhana Police Station, Ahmednagar) to the Central Investigation Department (CID). The Court examined the status of both investigations: a "B" summary had been submitted in Crime No. 642 of 2019, while a charge‑sheet had been filed in Crime No. 133 of 2016 and the related Sessions case (No. 148 of 2021) was pending at the charge‑framing stage. Since the investigations were already underway and procedural steps were in progress, the Court found no ground to entertain the petition. Consequently, the petition was dismissed as there was nothing left to adjudicate. The judgment was delivered by Judges Sandipkumar C. More and Vaishali Patil‑Jadhav on 20 August 2026.
