Bombay High Court

GOPINATH S/O. MANIKRAO SHELKEversusASARAM S/O. BHAGWANRAO JARHAD AND OTHERS

Disposal
DISPOSED OFF

Holding

The writ petition is dismissed as infructuous because the underlying criminal case has been dismissed.

Summary

The petitioner, Gopinath Manikrao Shelke, filed a criminal writ petition challenging the conduct of respondents. The petition was based on an earlier criminal proceeding, RCC No. 413 of 2015, pending before the Judicial Magistrate First Class Court‑4, Jalna. That original case was dismissed on 11 September 2025 for want of prosecution. The High Court examined whether the writ petition could continue in view of the dismissal. It held that with the substantive case dismissed, the writ petition became infructuous and therefore could not proceed. Consequently, the court disposed of the petition as infructuous.
