The court quashed the bail forfeiture, non‑bailable warrant, proclamation and arrest‑warrant orders, holding that they are set aside on account of the petitioner's payment undertaking without prejudice to the pending criminal appeal.
Summary
The petitioner, Suraj Kiran Mandal, challenged two orders of the Judicial Magistrate First Class, Andheri: one forfeiting his cash bail bond, issuing a non‑bailable warrant and proclamation in a case under Section 498A IPC, and another issuing an arrest warrant and directing special police in a domestic violence proceeding. The petitioner offered to pay an immediate sum of Rs.25,000 and Rs.5,000 monthly as interim maintenance to the respondent, without prejudice to the pending Criminal Appeal No.222 of 2024. The respondent consented to the payment arrangement and had no objection to setting aside the impugned orders. By mutual consent, the court quashed both the bail forfeiture and the arrest‑warrant orders, directing the petitioner to make the stipulated payments pending the appeal. The court clarified that the payments are without prejudice to the parties' rights and urged the Sessions Court to expedite the pending criminal appeal. The writ petition was consequently disposed.
Issues considered
- Whether the order forfeiting the cash bail bond, issuing a non‑bailable warrant and proclamation in a Section 498A case is legally valid.
- Whether the arrest warrant and direction for special police in the domestic‑violence proceedings are valid.
- Whether the orders can be set aside on the basis of the petitioner's undertaking to pay interim maintenance.
