Holding

The Court directed the Education Officer to decide the appointment proposal within four weeks and, if approved, to issue the salary‑aid ID and pay arrears within the stipulated timelines.

Summary

The petitioner, Vishal Vilas Kamble, applied for the post of junior clerk and a proposal for his appointment was submitted on 2 March 2026 but remained undecided. He filed a writ petition seeking a direction to the Education Officer (Respondent No.5) to decide the proposal. The Court examined whether it could issue a mandamus directing the officer to act within a reasonable time and also order the issuance of a salary‑aid ID and payment of arrears if the appointment is approved. Finding no substantive dispute beyond the administrative delay, the Court directed the Education Officer to decide the proposal within four weeks from the date of the order. It further ordered that, upon approval, the appropriate authority issue the salary‑aid ID within three weeks and pay any arrears within two weeks. The petition was consequently disposed with these directions.

Issues considered

  • Whether the High Court can issue a mandamus directing the Education Officer to decide the appointment proposal within a specified period.
