The order dated 21 December 2021 in W.P. 8824 of 2021 is applicable to all similarly situated petitioners, entitling them to the one-step pay scale subject to verification.
Summary
The petitioners, employees posted in tribal and PESA areas, sought a writ directing the State to grant them the promotional one-step pay scale (Ekstar) and arrears from the date of posting, relying on earlier judgments and Government Resolutions dated 29 February 2024 and 4 June 2025. The Court examined the submissions and the series of orders previously issued in similar cases, noting that the order dated 21 December 2021 in Writ Petition No. 8824 of 2021 had been held applicable to all such cases. Finding no material difference, the Court declined to depart from that precedent. Accordingly, the petition was allowed, directing the Education Officer to verify the petitioners' records within 30 days, grant the one-step pay‑scale benefits and arrears where no legal impediment exists, and follow a prescribed procedure for any ineligible cases. The judgment reiterates that the earlier 2021 order governs the entitlement to the one-step pay scale for employees serving in tribal and PESA areas.
Issues considered
- Whether the petitioners are entitled to the one-step (Ekstar) promotional pay scale and arrears for service in tribal/PESA areas.
- Whether the order dated 21 December 2021 in W.P. 8824 of 2021 is binding on all similar cases.
