SUN ROCK MUNICIPAL EMPLOYEE CHSversusTHE MUNICIPAL COMMISSIONER MCGM AND 8 ORS.

Holding

The Court held that the MCGM must be directed to carry the Section 53(1) notice of the M.R.T.P. Act to its logical conclusion, subject to any legal impediment.

Summary

The Sun Rock Municipal Employees Co‑operative Society Ltd. filed a writ petition seeking a direction to the Municipal Corporation of Greater Mumbai (MCGM) to act on an unauthorized construction. Respondents 6 and 7 have a pending civil suit in the City Civil Court, Dindoshi, where interim protection has been granted. The petitioners had applied for intervention in that suit but indicated they would withdraw the application as it may not be maintainable. The Court noted that once MCGM issues a notice under Section 53(1) of the Maharashtra Regional and Town Planning (M.R.T.P.) Act, it must be pursued to its logical conclusion, subject to any legal impediment. Accordingly, the Court directed MCGM to take the Section 53(1) notice to its conclusion and allowed the petitioners to seek inspection of the related files within four weeks. The writ petition was disposed.

Issues considered

  • Whether the High Court can direct the MCGM to pursue a notice issued under Section 53(1) of the M.R.T.P. Act.
  • Whether the petitioners’ application for intervention in the pending civil suit is maintainable.
